{"id":12967,"date":"2025-02-24T18:07:42","date_gmt":"2025-02-24T18:07:42","guid":{"rendered":"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?p=12967"},"modified":"2025-02-24T18:50:51","modified_gmt":"2025-02-24T18:50:51","slug":"weve-been-watching-you-rattlechain-redevelopments-limited","status":"publish","type":"post","link":"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?p=12967","title":{"rendered":"We&#8217;ve been watching you- &#8220;Rattlechain Redevelopments Limited&#8221;"},"content":{"rendered":"<p><strong><span style=\"font-size: 18pt;\">WLBRL INVESTIGATION- A COMPLEX WEB OF DIRTY BUSINESS DEALS<\/span><\/strong><\/p>\n<p>For some time, I have been aware and monitoring two companies by the name of <strong>&#8220;Rattlechain Redevelopments Ltd&#8221;<\/strong> and <strong>&#8220;Coneygre Redevelopments Limited&#8221;<\/strong>&#8211; these directly relate to land interests off site of Rattlechain lagoon- <a href=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=8344\" target=\"_blank\" rel=\"noopener\">The former Duport&#8217;s Tip<\/a> and surrounding East of Rose Lane, and also the <a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?p=10543\" target=\"_blank\" rel=\"noopener\">land off the Coneygree Road open space<\/a> in Tipton- both a part of the ludicrous &#8220;garden city&#8221; proposals in the &#8220;Dudley Port Supplementary Planning&#8221; Document and now &#8220;The Sandwell Local Plan&#8221;.<\/p>\n<p>These two sites are directly linked in that they were for a substantial period used as foundry sand graveyards by the company <strong>&#8220;Mintworth&#8221;\u00a0<\/strong>, formerly <strong>Birlee Industrial Ltd<\/strong>, and often by many other aliases by The Hurst family.<\/p>\n<p>Mintworth were responsible for the former Severn Trent Water sewage works development, now Callaghan and Wilson Drives and the unfolding <a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?p=8278\" target=\"_blank\" rel=\"noopener\">&#8220;misery&#8221;<\/a> of a ten year operation that was supposedly only going to last two.<\/p>\n<p>It is apparent that for many years, the principal driver of Mintworth in all its forms<strong>\u00a0<\/strong>was<strong> John S Hurst, not to be confused with his Son, John L J Hurst, or JH Jnr. <\/strong>\u00a0Unfortunately, The Black Country Development Corporation officers were unable to see through the sandcastle piles in the early 1990&#8217;s with the grand proposals for the sewage works and surrounding land. Indeed the bogus Cremer and Warner report conducted at Rattlechain lagoon was devised because it was coveted as a major dumping pit for extra profit. Thank God this never transpired because <strong>the chemical waste is totally incompatible with infilling it with foundry sand, and this will never change.<\/strong> Closed shop meetings not involving any residential input were orchestrated from Black Country House, the lair of the BCDC.<\/p>\n<p>On gaining planning permission, via a dubious appeal where the adjoining <strong><span style=\"color: #ff0000;\">&#8220;bad use neighbour&#8221;<\/span> <\/strong>lagoon was the main reason for Sandwell Council&#8217;s original refusal, Mintworth effectively vanished off the scene, <a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?p=8397\" target=\"_blank\" rel=\"noopener\">except for a metal tatting exercise<\/a>, leaving behind them a present to the local community of &#8220;private open space&#8221;- vast over tipped piles of foundry sand\u00a0 that later greened over, bizarrely populated by pampas grass and stunted Christmas Trees. Some areas however did produce mature trees leaving the site green and rewilded- something the Hurst&#8217;s never planned during their tatting exercises on the site.<\/p>\n<p>Mintworth did however re-emerge like a phoenix (or a foundry sand dragon from its own dust), at the Sandwell Site Allocations Delivery Plan Document , (SSADPD), in 2011 with consultants RPS putting forward housing proposals, <strong><em>but not apparently as owners<\/em><\/strong>.\u00a0 \ud83d\ude06<\/p>\n<p><strong>A DUBIOUS &#8220;OFFSHORE&#8221; OWNERSHIP<\/strong><\/p>\n<p>The transition of some of this land for apparently peanuts is shown in four land registry documents where the titles appear to have been transferred to <strong>&#8220;Denver Limited &#8220;<\/strong> registered in Jersey on <strong>2\/2\/2006<\/strong>. the amount paid for these titles is a token joke, without a doubt at <strong>\u00a35,000<\/strong> a pop.<\/p>\n<p>One should be reminded of the EA statement about Mintworth Quays concerning the site licence in documents associated with the Sandwell site allocations delivery plan proposals. <span style=\"color: #ff0000;\">&#8220;The permit for the Rattlechain Tip no longer exists. They appear to be quite active in dealing with offshore registered land ownerships in this part of the world via the old Ship Canal House.\u00a0 \ud83d\ude09<\/p>\n<p><strong>Nothing happened in many years since that allocation was presented in 2011<\/strong>. I am not sure what Mintworth have been doing for quite some time, but note they had a first notice of strike off at one point.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2021\/05\/mintworthstrike.pdf\">mintworthstrike<\/a><\/p>\n<p>Of course, myself and many residents of the Temple Way Estate and users of Sheepwash Local Nature Reserve organised a petition to stop the ludicrous &#8220;Garden City&#8221; proposals put forward in Sandwell council&#8217;s Dudley Port Supplementary Planning Document.<\/p>\n<p><strong>I would add that this opposition from residents and site users is still very much totally against any further development, or &#8220;redevelopment&#8221; or more accurately regurgitation of a stale old pipedream of a tatter and his son and moving around vast amounts of foundry sand to create a new misery by adding yet more under &#8220;stabilising&#8221; or &#8220;surcharging the mound&#8221;.\u00a0 Pile of bollocks. I have looked at how they sell off land formerly in the public ownership and land bank this <a href=\"https:\/\/saveoursandwellcanadageese.org.uk\/?p=3771\" target=\"_blank\" rel=\"noopener\">HERE.<\/a><\/p>\n<p>They do little to remediate land that their company contaminated with human excrement like that at Friar park and expect the tax payer to pick up the tab whilst their bloated fat cat CEO and shareholders cream off the state aid &#8220;clean up funds&#8221; in doing so. Indeed when the planning committee at the council looked minded to refuse the planning decision for the former Tividale sewage works, an individual from this company attempted to subvert the planning process demanding a meeting with the chief executive prior to the planning committee meeting. What a bloody cheek! I wonder WTF this had to do with them as a company or him as an individual when they had &#8220;sold&#8221; the land to Mintworth in 1988?\u00a0 Was there a get out clause I wonder if development was refused or a nice fat personal bonus for closing the deal?<\/p>\n<p>The letter below is evidence of what I have stated above from STW&#8217;s own position.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/02\/ludlow1.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-16511\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/02\/ludlow1-240x300.png\" alt=\"\" width=\"500\" height=\"624\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/02\/ludlow1-240x300.png 240w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/02\/ludlow1.png 517w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>I put in an email request to CEO Liv Garfield on this transaction, also noting that a new mortgage charge had been filed under the company <strong><span style=\"color: #ff0000;\">&#8220;Rattlechain Redevelopments Limited&#8221;<\/span><\/strong> dated <strong>19th May 2020.\u00a0<\/strong><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/02\/companies_house_document-8.pdf\"><span style=\"font-size: 18pt;\">companies_house_document (8)<\/span><\/a><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/01\/redev4.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-16452\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/01\/redev4-284x300.png\" alt=\"\" width=\"484\" height=\"511\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/01\/redev4-284x300.png 284w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2025\/01\/redev4.png 531w\" sizes=\"(max-width: 484px) 100vw, 484px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>I received this reply from a Justin Bailey.<\/p>\n<p><strong><em><span style=\"color: #ff0000;\">&#8220;ST Classification: LEGALLY PRIVILEGED<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">Good afternoon Mr Carroll,<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">I have been passed your email of 19<\/span><\/em><em><span style=\"color: #ff0000;\"><sup>th<\/sup><\/span><\/em><em><span style=\"color: #ff0000;\">\u00a0January to Liv Garfield in my role as Head of Property. This matter is historic and so it has taken a few days to research the facts.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">I appreciate that you are passionate about the environment, which is to be applauded, and your investigations have led you to believe that Severn Trent are involved in or are in control of the future use of the site. It is not.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">The land in question was sold by Severn Trent Water Authority (as was) in April 1988 and the terms of this sale were recorded in a contract for sale entered into in the same year with Mintworth Limited. Several onward sales of the land have occurred since.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">The original sale contract from 1988 contained what is known as an \u2018overage\u2019 provision which is common practice in the property industry. It provides that if future changes in use of the land takes place, that Severn Trent is entitled to receive a share of any profit derived from that change of use. This right lasts for a period of 80 years.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">The document you obtained from Land Registry is merely a subsequent purchaser, of part of the original land sold, entering into a deed to record a legal charge on their title concerning the overage provision in favour of Severt Trent. This is not a mortgage in the everyday use of the word and Severn Trent is not lending money to Rattlechain Developments and has no dealing with them.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">As regards the future use of the site, Severn Trent are not involved.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">Considering the above, I do not believe there is cause to correspond further on this matter.<\/span><\/em><\/strong><\/p>\n<p><strong>Justin Bailey\u00a0<em><span style=\"color: #ff0000;\">(He\/Him)<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">Head of Property &amp; Strategic Resource Options<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">Severn Trent Water Ltd&#8221;<\/span><\/em><\/strong><\/p>\n<p>This therefore confirms that Severn Trent still have a financial interest in this land gaining planning permission for yet more housing. They can attempt to divorce themselves from Rattlechain Redevelopments all they like, but<a href=\"https:\/\/en.wikipedia.org\/wiki\/Land-sale_overage\" target=\"_blank\" rel=\"noopener\"> overage means they stand to gain from any permission granted<\/a> whilst they also remain a statutory consultee when any application arises. The matter below was raised by <strong>Jeff Rooker MP,<\/strong> whom I must say as a former Labour MP I have learnt to have a great deal of respect for in that he raised pollution issues like this on a regular basis, particularly with the scum from Leigh Environmental in Walsall.<\/p>\n<p>The <strong>14th December 1988 Birmingham News\u00a0<\/strong>raised concerns about the soaring costs associated with the flagship <a href=\"https:\/\/en.wikipedia.org\/wiki\/ICC_Birmingham\" target=\"_blank\" rel=\"noopener\">convention centre\u00a0 ICC<\/a> and PJ\u00a0 Murray&#8217;s role in demolishing the former brewery that had been the obstacle in the way. The planning authority has visited the site and noted that works have now ceased.\u00a0\u00a0If a planning application is made in due course we would review any feasibility works that had been undertaken in consultation with Environmental Health. These bids were rigged, deceiving the customer that they were competitive when that was not the case. Each of the 10 firms was involved in at least one instance of bid rigging between January 2013 and June 2018. The fines for each are: Brown and Mason (\u00a32,400,000), Cantillon (\u00a31,920,000), Clifford Devlin (\u00a3423,615), <strong>DSM (\u00a31,400,000),<\/strong> Erith (\u00a317,568,800), JF Hunt (\u00a35,600,000), Keltbray (\u00a316,000,000), McGee (\u00a33,766,278), Scudder (\u00a38,256,264) and Squibb (\u00a32,000,000).&#8221;<\/span><\/em><\/div>\n<div><\/div>\n<div><\/div>\n<div><span style=\"font-size: 12pt;\">The date of this fine was <strong>March 2023<\/strong>, and so I put in an foi request to the CMA asking for more details about the time of the cover bidding fraud offences committed by DSM to gauge if this was within the Kelly family run era.\u00a0<\/span><\/div>\n<div><span style=\"font-size: 12pt;\"><a href=\"https:\/\/www.whatdotheyknow.com\/request\/construction_firms_fined_nearly\/response\/2913600\/attach\/3\/IAT%20FOIA%201429%20CMA%20Response.pdf?cookie_passthrough=1\" target=\"_blank\" rel=\"noopener\">The CMA replied<\/a> with a thorough response giving a handy table of the cartel fraudsters and the projects they had been involved in rigging.<\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div><span style=\"font-size: 12pt;\">In respect of DSM, we got the following.<\/span><\/div>\n<div><span style=\"font-size: 12pt;\"> &#8220;The Decision was addressed to the following undertakings (either because they were <\/span><br \/>\n<span style=\"font-size: 12pt;\">the undertaking involved in the infringing conduct or because they were the parent or <\/span><br \/>\n<span style=\"font-size: 12pt;\">economic company of that undertaking):\u00a0<\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div><strong><span style=\"font-size: 12pt; This <\/span><\/strong><strong><span style=\"font-size: 12pt; color: #ff0000;\">concerned a tender for demolition services relating to Coventry University\u2019s Civic <\/span><\/strong><strong><span style=\"font-size: 12pt; color: #ff0000;\">Centre Scheme.&#8221;<\/span><\/strong><\/div>\n<div><\/div>\n<div><strong><span style=\"font-size: 12pt;\">Incredibly, this job is listed on their portfolio website, but no mention of any cartel fraud!\u00a0<\/span><\/strong><\/div>\n<div><\/div>\n<div><span style=\"font-size: 12pt;\">With this is mind, one wonders how this company are still able to secure large contracts with players like Wolverhampton City Council, but I suppose local authorities as we have seen do not play with a straight bat either when it comes to using and misusing public money- Monopoly is their game!\u00a0<\/span><\/div>\n<div><span style=\"font-size: 12pt;\">This whole demolition\/construction industry is obviously institutionally corrupt to its core with development agencies like the former Black Country Development Corporation and now the West Midlands Combined Authority talking up &#8220;regeneration&#8221;, &#8220;growth&#8221; etc and no doubt the political players enjoy a similar cartel of having their palms greased for services rendered.\u00a0<\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div><span style=\"font-size: 12pt;\"><strong><span style=\"font-size: 18pt;\">THE BOTTOM LINE<\/span><\/strong><\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div><span style=\"font-size: 12pt;\">One thing is absolutely clear here in that any proposal\u00a0 for residential development on this Kelly owned land will be vehemently opposed at every stage, certainly if we see the bogus &#8220;<strong>con<\/strong>sultation&#8221; exercise with a drafted in PR firm attempting to present pretty pictures of &#8220;master planning&#8221; and recycle something that they think no one remembers from circa 1990, or anything else.<\/span><\/div>\n<div><\/div>\n<div><span style=\"font-size: 14pt;\"><strong>Be in no doubt, the thousands of tonnes of foundry sand buried here and the associated dusts and the hazardous waste and scrap buried beneath that.
