It is linked through the same operators- namely <strong>&#8220;Mintworth&#8221;<\/strong> and also their vast amounts of dumped foundry sand- much of it coming from the former foundry when it was operational.<\/p>\n<div id=\"attachment_12795\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2020\/09\/confo1.png\"><img aria-describedby=\"caption-attachment-12795\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-12795\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2020\/09\/confo1-300x176.png\" alt=\"\" width=\"500\" height=\"293\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2020\/09\/confo1-300x176.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2020\/09\/confo1-768x451.png 768w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2020\/09\/confo1.png 1012w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-12795\" class=\"wp-caption-text\">Former Coneygre Foundry from 1935, showing canal basins and largely flat land at the Birmingham Old mainline canal side.<\/p><\/div>\n<p>This site, like that of the former Duport&#8217;s Tip is one of the sites identified in the ludicrous so called <a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?p=8333\" target=\"_blank\" rel=\"noopener\">&#8220;Dudley Port Garden City&#8221; <\/a>prospectus promoted by Sandwell council. There have been many twists and turns with this site, which are still currently evolving, and it will be interesting to see how they play out from a planning point of view. People should read this for information purposes to perhaps make their own conclusions.<\/p>\n<p>This first post of three looks at Mintworth&#8217;s legacy at this site; the abysmal over tipping of foundry sand\u00a0whilst making a &#8220;mint&#8221; out of part of a site and leaving a shit tip behind that they didn&#8217;t want, and which would prove too costly\u00a0for them to remediate- just like their other site less than a mile away.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/johnnymintworth.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-10430\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/johnnymintworth-251x300.png\" alt=\"\" width=\"350\" height=\"419\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/johnnymintworth-251x300.png 251w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/johnnymintworth.png 510w\" sizes=\"(max-width: 350px) 100vw, 350px\" \/><\/a><\/p>\n<p>We start the story with a description by <strong>Frank Pomlett<\/strong>&#8211; a director of Mintworth at the time, and his claimed history of the Coneygre Foundry site, at this point in time owned by <strong>Birmid Qualcast Limited<\/strong>.\u00a0 I cannot verify any of the statements made within his, though note that it is Mintworth&#8217;s position of the matter when they applied for a planning permission in <strong>1985.<\/strong><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-7.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-10410\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-7-218x300.png\" alt=\"\" width=\"500\" height=\"688\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-7-218x300.png 218w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-7-768x1056.png 768w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-7-745x1024.png 745w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-7.png 1700w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>Pomlett claimed that <strong>37 mine shafts<\/strong> were spread over the 22 acre site, with in addition limestone workings that had a depth of <strong><span style=\"color: #ff0000;\">200 metres<\/span><\/strong>. That is an awful lot of sand and material required to fill such holes and to stabilise in order to ever achieve any prospect of built development!<\/p>\n<p>He estimates that <strong><span style=\"color: #ff0000;\">1 million tonnes of foundry waste<\/span><\/strong>\u00a0 arose from the Coneygre site, taking <strong><span style=\"color: #ff0000;\">200,000 return journeys to dump it.<\/span><\/strong><\/p>\n<p>Most interestingly he professes knowledge of the site in the 1960&#8217;s. We know at this time of course, that Mintworth did not exist, but Pomlett and fellow director <strong>John S Hurst&#8217;s<\/strong> former company <strong>&#8220;Birlee industrial limited&#8221;<\/strong> did.<\/p>\n<p>An old advert advertising the services of this waste tipper appeared in <strong>The Birmingham Daily post in\u00a0\u00a01977.<\/strong><\/p>\n<div id=\"attachment_10413\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/birlee14.png\"><img aria-describedby=\"caption-attachment-10413\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-10413\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/birlee14-300x198.png\" alt=\"\" width=\"500\" height=\"330\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/birlee14-300x198.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/birlee14-768x508.png 768w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/birlee14.png 982w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-10413\" class=\"wp-caption-text\">&#8220;Unlimited quantities&#8221;<\/p><\/div>\n<p>Pomlett&#8217;s enthusiasm for scrap metal recovery belies that fact that he and Hurst\u00a0 were basically just metal tatters from the foundry waste. The other side line industry that the sandmen used was the process of dumping the sand in the &#8220;<strong>cons<\/strong>truction industry,&#8221; He claims some 17,000 return journeys were made since 1965 shifting <strong><span style=\"color: #ff0000;\">200,000 tons<\/span> <\/strong>of foundry sand.<\/p>\n<p>This forms the background to Mintworth&#8217;s first foray into something bigger at this waste tip site when they submitted a planning application entitled<\/p>\n<p><span style=\"font-family: georgia,palatino,serif;\"><strong><span lang=\"EN\"><span style=\"color: #000000;\">DA\/18345 <\/span><\/span><span lang=\"EN\"><span style=\"color: #000000;\">|<\/span><\/span><span lang=\"EN\"> <span style=\"color: #000000;\">Infilling of site to plans R\/C\/BQ\/1 &amp; 2. <\/span><span style=\"color: #000000;\">|<\/span> <span style=\"color: #000000;\">Coneygre Foundry Site Coneygre Road Tipton.<\/span><\/span><\/strong><\/span><\/p>\n<p>This was submitted in 1984 under the guise of &#8220;land restoration&#8221;- now where have they used that term before. \ud83d\ude44<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-8.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-10414\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-8-212x300.png\" alt=\"\" width=\"400\" height=\"566\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-8-212x300.png 212w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-8-768x1086.png 768w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-8-724x1024.png 724w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-8.png 1472w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>Under Pomlett&#8217;s signature as &#8220;managing director&#8221;, a letter dated <strong>15th November 1984<\/strong> describes a five year plan to <em>import<\/em> <strong><span style=\"color: #ff0000;\">750,000 cubic metres<\/span> <\/strong>of fill to restore the site. One may ask why they <em>exported<\/em> it in the first place given his earlier boasts? We get the first nonsense of Mintworth&#8217;s &#8220;associate companies &#8220;<strong>Mintworth Transport Limited&#8221;<\/strong> and <strong>&#8220;Recommet&#8221;<\/strong> . <strong>They were of course all the same company with the same directors!<\/strong><\/p>\n<p>We learn that they have operated on a site at <strong>Bustleholme Quarry<\/strong>\u00a0 (as Birlee Industrial Limited\u00a0 in whose name the licence was approved), which is coming to the end of its life.\u00a0 This was site licence <strong><span style=\"color: #ff0000;\">SL88 which was approved on 15\/2\/1977 and the last input of waste (at least officially \ud83d\ude09 ) 1\/4\/1985 .<\/span><\/strong>\u00a0Basically the Coneygre site appears to be in\u00a0use as a profitable commercial toilet for Birlee\/Mintworth and the industrial foundry polluters they served.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-10.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-10415\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-10-213x300.png\" alt=\"\" width=\"400\" height=\"563\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-10-213x300.png 213w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-10-768x1081.png 768w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-10-728x1024.png 728w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2019\/04\/Scan_20190407-10.png 1403w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>In the report to the then <strong>West Midlands County Council<\/strong> deciding the plans it is noted<\/p>\n<blockquote><p><span style=\"font-size: 14pt;\"><strong><span style=\"color: #ff0000;\">&#8220;The site has been extensively tipped with foundry\u00a0 waste and there are four disused canal basins along the Northern boundary which have not been properly filled. This made clear the types of material allowed on site and to be used or stored. As always with Mintworth, a door opening leads to more requests, and presumption of further activities, which in their opinion never need any further clarification, even from the regulators or experts. It was exactly the same at Duport&#8217;s Tip. It is stated that &#8220;we have had metal screening plants &#8221; on the site for over 20 years and the equipment is portable and not fixed. He also argues on the point of the coal not being coal but &#8220;chattel&#8221; . It is revealed in the consultation report that the forestry commission would be paying for the planting of trees.<\/p>\n<p><span style=\"color: #ff0000;\">&#8220;To fully treat all located shafts on the site would be prohibitively expensive. They attempted with these applications to basically remove much of it and instead use it for their own purposes of storing their own waste materials. As always with this company, and as already stated, as soon as they were given any planning permission, this foot in the door approach would be followed up with another application to remove constraining conditions and instead insert some other scheme, which would further play to their advantage. Here is the evidence of how residents contacted the BCDC about the blight from Mintworth&#8217;s &#8220;dust creation scheme&#8221; .<\/p>\n<p><a time to Tony Rice of SMBC from Clive Dutton of BCDC \u00a0is interesting in terms of both of Mintworth&#8217;s sites. Again the lack of security is noted, as are Mintworth going &#8220;flat out&#8221;. It is noted that Dutton states that <strong><span style=\"color: #ff0000;\">&#8220;this should trigger our enforcement strategy for Coneygree. I noticed yesterday that the mound is enormous and that plant is currently operating on its summit. &#8221; <span style=\"color: #000000;\">He is unsure as to whether this was freshly tipped material or that supposedly going to &#8220;rattlechain&#8221;. <\/span><\/span><\/strong><\/p>\n<p>It is of course worth pointing out again that the BCDC were fully complicit in creating this farce. But why the lack of enforcement procedure , or even stripping the polluters of the licence altogether? It is a useful letter in that it provides many of the unsubstantiated claims made by Frank Pomlett from his 1984 application at the site- <strong>in fact it plagiarises it almost word for word if you compare this<\/strong>. The planning regime on both sites is also set out up to this point.<\/p>\n<p><strong><span style=\"color: #ff0000;\">&#8220;For reasons unknown to me Mintworth handed back the site licence (SL487) that allowed them to import foundry sand into Coneygree last year and ceased all work on site. It is worth noting that <strong>&#8220;Mintworth Limited&#8221;<\/strong> was dissolved in late 1993,\u00a0in addition\u00a0to\u00a0 the ludicrous <strong>&#8220;M Throwtin Limited&#8221;<\/strong> in September of the same year.
