{"id":8349,"date":"2017-06-17T20:35:14","date_gmt":"2017-06-17T20:35:14","guid":{"rendered":"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=8349"},"modified":"2020-08-27T13:41:43","modified_gmt":"2020-08-27T13:41:43","slug":"smbc-req-10-waste-licences","status":"publish","type":"page","link":"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=8349","title":{"rendered":"SMBC REQ  10  WASTE LICENCES SL113 and SL129"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p><u><span style=\"color: #0066cc;\">waste disposal site licences in Tividale <\/span><\/u><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/S7560017.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8363\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/S7560017-300x169.jpg\" alt=\"\" width=\"500\" height=\"281\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/S7560017-300x169.jpg 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/S7560017-768x432.jpg 768w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/S7560017-1024x576.jpg 1024w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/S7560017.jpg 1920w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>The <a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=4737\" target=\"_blank\" rel=\"noopener noreferrer\">demise of brickmaking at the former rattlechain brickworks <\/a>saw the site used as an indiscriminate waste dump- especially into the newer created pit to the East of the Albright and Wilson rattlechain lagoon and in the vicinity of Rose Lane which crossed the area owned by the brickworks- This would become known as &#8220;Duport&#8217;s Tip&#8221;.<\/p>\n<p>This constitutes 2 separate licence requests<\/p>\n<p><strong>WHAT DID WE ASK AND WHAT DID THEY KNOW?<\/strong><\/p>\n<p><strong>Request 1<\/strong><\/p>\n<p><em>&#8220;Please provide by electronic means the full site licences <strong>SL 129 Duport Properties Ltd Rattlechain Tip Tividale<\/strong> and also the subsequent amendment to enable work to be carried out as recommended by consultant hydrogeologist, to alleviate problem with polluted springs. <\/em><br \/>\n<em>Could you also provide the full site licence for <strong>SL113 Birlee Industrial Ltd, Rose Lane Tividale. <\/strong><\/em><br \/>\n<em>Unless otherwise stated in the site licences could you also provide a summary of when these licences may have been surrendered and the sites remediated, or conveniently not and the reasons for this?&#8221;<\/em><\/p>\n<p>Sandwell council <a href=\"https:\/\/www.whatdotheyknow.com\/request\/52305\/response\/134428\/attach\/5\/Letter%20request%2052305%203f5f56f6%20waste%20disposal%20licenses%20in%20Tividale.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">responded<\/a>\u00a0also attaching the two site licences also adding<\/p>\n<p><em><span style=\"color: #ff0000;\">i). Site licences SL129 and SL113 are noted to have been issued\u00a0\u00a0 by <strong>West Midlands County Council<\/strong>.\u00a0 This Division has no\u00a0\u00a0records regarding the surrender of the licences. <\/span><\/em><br \/>\n<em><span style=\"color: #ff0000;\">\u00a0ii). The area to which SL129 pertains is noted to be undeveloped\u00a0\u00a0 at this time and the Division has no record of what works\u00a0\u00a0might have been undertaken in relation to this Licence.\u00a0\u00a0\u00a0<\/span><\/em><\/p>\n<p><em><span style=\"color: #ff0000;\"> iii). The area to which SL113 related has been largely developed\u00a0\u00a0for residential use. It is understood that development occurred\u00a0\u00a0 in the 1980\u2019s in accordance with the requirements of the\u00a0\u00a0planning regime. <\/span><\/em><\/p>\n<p>The two site licences can be downloaded below.<\/p>\n<p><a href=\"https:\/\/www.whatdotheyknow.com\/request\/52305\/response\/134428\/attach\/4\/SL113.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">SL113 BIRLEE INDUSTRIAL LIMITED. <\/a><\/p>\n<p><strong>Discussion.<\/strong><\/p>\n<p>The Birlee licence approved\u00a0on 8th April 1978\u00a0included 28 conditions including the important waste criteria<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-1.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8352\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-1-300x171.png\" alt=\"\" width=\"500\" height=\"285\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-1-300x171.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-1.png 613w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-2.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8353\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-2-300x81.png\" alt=\"\" width=\"500\" height=\"135\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-2-300x81.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-2.png 613w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>NB. NOTE THAT THIS LICENCE DOES NOT EXCLUDE ASBESTOS WITH THE KEY WORD <span style=\"color: #ff0000;\">&#8220;WHOLLY&#8221; OF. <a href=\"http:\/\/www.hse.gov.uk\/asbestos\/dangerous.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #000000;\">Roofing asbestos<\/span><\/a><\/span><\/p>\n<p>A map from this licence indicates it ran in a narrow strip between already &#8220;filled ground&#8221; parallel with Rose Lane as it then stood. This filled ground however is bracketed &#8220;(Birlee) (formerly Groves).&#8221;<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-3.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8354\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-3-210x300.png\" alt=\"\" width=\"400\" height=\"571\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-3-210x300.png 210w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee-3.png 395w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>The site directors of Birlee Industrial Limited were <strong>John Stewart Hurst<\/strong>, and <strong>Frank Ewart Pomlett.<\/strong><\/p>\n<p><strong>Modification<\/strong><\/p>\n<p>On December 20th 1980, at the request of the company and also in conjunction with another site licence that they had applied for SL303, the licence was slightly reworded with the bizarre statement that the waste should not contain any &#8220;hazardous waste&#8221; that could be harmful to animal or human health. <span style=\"color: #ff0000;\">THEY HAD APPROVED ASBESTOS BEING ALLOWED TO BE DEPOSITED! \ud83d\ude25\u00a0<\/span><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee13.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8420\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee13-300x221.png\" alt=\"\" width=\"300\" height=\"221\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee13-300x221.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/birlee13.png 725w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><a href=\"https:\/\/www.whatdotheyknow.com\/request\/52305\/response\/134428\/attach\/6\/SL129.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">SL129 DUPORT PROPERTIES LIMITED<\/a><\/p>\n<p>Located according to the site licence at &#8220;Sedgley Road East&#8221; Duport Properties limited had at the time at least one director <strong>John Turner. <\/strong><\/p>\n<p>The licence having 40 conditions indicated that &#8220;Tipping should only take place West of Rose Lane&#8221; as\u00a0per condition 6. Waste criteria were defined by conditions 9 and 10 and by the attached notes.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip1.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8355\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip1-300x155.png\" alt=\"\" width=\"500\" height=\"259\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip1-300x155.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip1.png 682w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>IT IS OF GRAVE CONCERN THAT <strong>ASBESTOS IS NOT EXCLUDED<\/strong> FROM THIS SITE LICENCE ADVOCATING THE TIPPING OF &#8220;COMMERCIAL&#8221; AND &#8220;NON-HAZARDOUS INDUSTRIAL WASTE&#8221;, MOREOVER AN OVERSITE THAT <a href=\"http:\/\/www.hse.gov.uk\/asbestos\/dangerous.htm\" target=\"_blank\" rel=\"noopener noreferrer\">THIS COMPOUND IS VERY HARMFUL AND <span style=\"color: #ff0000;\">&#8220;HAZARDOUS&#8221;<\/span> TO HUMAN HEALTH<\/a>!<\/p>\n<div id=\"attachment_8356\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP2.png\"><img aria-describedby=\"caption-attachment-8356\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-8356\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP2-300x29.png\" alt=\"\" width=\"500\" height=\"49\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP2-300x29.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP2.png 608w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-8356\" class=\"wp-caption-text\">&#8220;ANY&#8221;, NOT &#8220;NO&#8221;<\/p><\/div>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP3.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8357\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP3-300x154.png\" alt=\"\" width=\"500\" height=\"256\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP3-300x154.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/DUPTIP3.png 663w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>A MAP OF THIS SITE IS SHOWN BELOW. I HAVE ANNOTATED THIS TO SHOW THE LOCATION IN RELATION TO RATTLECHAIN LAGOON. THE FORMER SEWAGE WORKS IS NOW THE LOCATION OF CALLAGHAN AND WILSON DRIVES.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip-1.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8358\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip-1-300x211.png\" alt=\"\" width=\"500\" height=\"351\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip-1-300x211.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip-1.png 561w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p><strong>Modifications<\/strong><\/p>\n<p>The licence indicates that three modifications were made to this licence which we understand operations ceasing in 1986.<\/p>\n<p>The first is dated <strong>23rd February 1979.<\/strong><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip4.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8359\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip4-300x266.png\" alt=\"\" width=\"500\" height=\"444\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip4-300x266.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip4.png 725w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>There is no explanation as to what Harvey considered to be &#8220;a wet arrestor&#8221;, but this appears to allow the start of sanctioning of wet materials into the former clay pit, already partly infilled with the dry materials.<\/p>\n<p>The second amendment (though out of sync appearing after amendment 3 in the pdf) is dated <strong>6th November 1979<\/strong>.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip5.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8360\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip5-300x286.png\" alt=\"\" width=\"500\" height=\"476\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip5-300x286.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip5.png 673w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>This modification deleted conditions 10 and 12 relating to infilling only within the marlhole, effectively allowing a free for all over the site. This effectively made protection of the River Tame far less certain given that Harvey had previously allowed leachable material to be added to the pit, and now presumably the entire site. Three conditions 41-43 were added, which we\u00a0hinted at\u00a0in the original FOI request concerning the problem that had arisen with &#8220;polluted springs&#8221;. These conditions are so vague as to be meaningless.<\/p>\n<p>The\u00a0third amendment is dated <strong>11th February 1980.<\/strong><\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip6.png\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-8361\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip6-300x294.png\" alt=\"\" width=\"500\" height=\"490\" srcset=\"https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip6-300x294.png 300w, https:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2017\/06\/duptip6.png 548w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>This amendment deleted conditions 5 &#8211; deleting the condition of any criminal offence being committed if the licence was not followed! One has to wonder what the point of this licence actually was at this point, other than allowing a free for all free pass.<\/p>\n<p>Harvey finally adds his &#8220;piece de resistance&#8221; to his disastrous waste county disposal officer career by sanctioning the tipping of putrescible wastes into and around the pit, adding to the non defined &#8220;non- hazardous&#8221; and &#8220;wet arrestor waste&#8221; that he had already allowed this shambolic company to dump into a clay pit and around it.<\/p>\n<p>Scrap wood from the vono works and god knows what else was now slung into this pit in anything but a controlled fashion. Johnson , Poole and Bloomer were based in Brieley Hill.<\/p>\n<p><strong>COMMENT.<\/strong><\/p>\n<p>This request should be read in conjunction with another to The Environment agency concerning another <a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=8366\" target=\"_blank\" rel=\"noopener noreferrer\">Birlee Industrial site licence SL303 <\/a>in the same area.<\/p>\n<p>There are clear links between the two companies, Birlee Industrial Limited and Duport Properties limited, and we have considerable correspondence between the parties and the consultants- Johnson, Poole and Bloomer whom they shared, their mutual solicitor),\u00a0\u00a0and Ken Harvey.
