The effluent treatment slurry was a slurry of calcium phosphate in water.\u201d<\/strong><\/p>\n<p>This account of waste at Rattlechain lagoon is the account given by Health and Safety Director Tom Dutton of Rhodia and formerly Albright and Wilson.<br \/>\n<strong>WHAT DID WE ASK?<\/strong><\/p>\n<p>1. Can you confirm what hazardous substance consents are in operation for this site for Rhodia and Thermphos.<br \/>\n2.A list of the hazardous substances and the allowed quantities that are allowed to be stored at the site?<br \/>\n3. The <a title=\"UN CODES\" href=\"http:\/\/en.wikipedia.org\/wiki\/UN_number\" target=\"_blank\" rel=\"noopener\">UN<\/a> and <a title=\"read this\" href=\"http:\/\/the-ncec.com\/hazchem\/\" target=\"_blank\" rel=\"noopener\">Kemlar codes <\/a>for these substances and the nature of their hazard classification and risk phrases and safety phrases e.g flammability, toxicity and effects in the environment.<\/p>\n<p><strong>WHY DID WE ASK THIS?<\/strong><\/p>\n<p>We wanted to know\u00a0what substances are or were allowed to be stored at this site and the potential implications for these chemicals being present in the waste stream at Rattlechain. Local residents living around the Langley\u00a0site may be blissfully unaware of these chemicals and their toxic properties. They rely on the company to maintain safety on the site, and the regulators to hold them to account, but as has been demonstrated, this has failed in the past.<\/p>\n<p><strong>WHAT DID THEY KNOW?<\/strong><\/p>\n<p>The <a title=\"Sand 1\" href=\"https:\/\/www.whatdotheyknow.com\/request\/hazardous_substance_consents_at#incoming-97902\" target=\"_blank\" rel=\"noopener\">first response <\/a>from Sandwell was totally unacceptable, and stated<\/p>\n<p>&#8220;I have spoken to John Baker, Development &amp; Regulatory Services Manager, and he has asked that you contact him to discuss your request further. He has suggested that it may be of use to you to come in to view the documents and discuss with him what information you require.&#8221;<\/p>\n<p>As another user of the Whatdotheyknow website <a title=\"comment\" href=\"ttps:\/\/www.whatdotheyknow.com\/request\/hazardous_substance_consents_at#comment-11754\" target=\"_blank\" rel=\"noopener\">stated<\/a><\/p>\n<p><strong><span style=\"color: #ff0000;\">&#8220;I would like to see the full and open answers to this request on this site so that we can all see\u00a0.<\/span> <span style=\"color: #ff0000;\">This is the main reason why the request was made on this site.&#8221; <\/span><\/strong><\/p>\n<p>Needless to say we asked them to comply with the law and state what information they held. After delay they provided some of the requested information with <a title=\"Sand 2\" href=\"https:\/\/www.whatdotheyknow.com\/request\/36661\/response\/102097\/attach\/3\/ENQ%201%20106226055%20Mr%20Carroll%20Rhodia%20and%20Thermphos%20Response2.pdf\" target=\"_blank\" rel=\"noopener\">this response.<\/a><\/p>\n<p align=\"left\"><strong><span style=\"font-size: medium;\">&#8220;It has been confirmed to us that there is no reference to a property called Thermphos on our Hazardous Substances Consent Register. Apart from Rhodia, the only other property in Trinity Street, Oldbury marked on the Register is Rosier Services. All necessary consents are in place and all properties are regularly inspected by the HSE.<\/span><\/strong><\/p>\n<p align=\"left\"><strong><span style=\"font-size: medium;\">Please find attached copies of all application forms for Hazardous Substances Consent made by Rhodia and Rosier Services. The application forms detail the types of chemicals and quantities applied for to be stored on each site.<\/span><\/strong><\/p>\n<p align=\"left\"><strong><span style=\"font-size: medium;\">\u00a0<\/span><span style=\"font-size: medium;\">In regards to question 3, our Officer does not hold this information. He suggests that you approach the HSE for guidance regarding this information. The Rosier services site is last. <strong>NB THIS IS THE OLD ICI SITE AND PREVIOUSLY TO THAT\u00a0CHANCE AND HUNT,LOCATED RIGHT NEXT TO THE AW\/RHODIA SITE,\u00a0THE SITE THAT SHARED THE CHEMICAL ARM (HOUGHTON BRANCH CANAL.)\u00a0<\/strong><\/p>\n<p align=\"left\">It has become clear that in respect of application HS\/026 supplied in this request, this is NOT the application for this Hazardous substance consent, but the HS consent for HS\/021 held in the HS\/026 file. The correct substance consent for this application can be found <a title=\"HS\/026\" href=\"http:\/\/webcaps.sandwell.gov.uk\/publicaccess\/files\/E2D71929348E2237B686D71019EE9F34\/pdf\/HS026-TWO_MEMOS___APPLICATION_FORM-164222.pdf\" target=\"_blank\" rel=\"noopener\">HERE.<\/a><\/p>\n<p align=\"left\"><a title=\"HS\/032\" href=\"https:\/\/www.whatdotheyknow.com\/request\/36661\/response\/102097\/attach\/6\/Rhodia30002.pdf\" target=\"_blank\" rel=\"noopener\">HS\/032<\/a><\/p>\n<p><a title=\"Rosier services\" href=\"https:\/\/www.whatdotheyknow.com\/request\/36661\/response\/102097\/attach\/5\/Rhodia20002.pdf\" target=\"_blank\" rel=\"noopener\">ROSIER SERVICES<\/a><\/p>\n<p>&nbsp;<\/p>\n<p><strong>WHAT DOES THIS MEAN?<\/strong><\/p>\n<p>We have looked in more detail at these hazardous substance consents and the chemicals concerned at the following page on <a title=\"haz substances\" href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=1075\" target=\"_blank\" rel=\"noopener\">this website<\/a>.\u00a0\u00a0An additional consent <span style=\"color: #ff0000;\">HS\/034<\/span> was missed off the list and\u00a0we have looked at this\u00a0\u00a0<a title=\"HS\/034\" href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/?page_id=1858\" target=\"_blank\" rel=\"noopener\">HERE<\/a>.\u00a0 The consents used to be\u00a0 found on Sandwell council&#8217;s planning portal website under the Trinity Street Address, yet in the last couple of years it appears that someone in this authority has chosen to remove all of the associated documents and details that were once there. <strong>One wonders WHY, and how exactly does this make the council look transparent when it only suits the business polluter applicant to hide this information from public scrutiny? \u00a0<\/strong><\/p>\n<p>The trouble with these Hazardous waste consents in general is that councillors wave them through, or they are made through &#8220;delegated decision&#8221; by officers\u00a0because they don&#8217;t have the necessary\u00a0scientific guidance to be able to scrutinise them. The HSE, Environment Agency and fire services rarely object, as the question is<span style=\"color: #ff0000;\"> &#8220;would additional quantities of such substances pose a greater significant risk to the public if allowed?&#8221;<\/span> This is a completely blinkered\u00a0 way of looking\u00a0at a situation that could be putting peoples lives at risk unnecessarily, based entirely on allowing a chemical business to expand its activities.\u00a0 When the type of materials\u00a0such as the ones consented here\u00a0are present on your doorstep, what difference would a few extra tonnes make if it all went up in smoke?<\/p>\n<p>The quantities\u00a0are TOO GREAT TO BE &#8220;SAFE&#8221;.<\/p>\n<p><a href=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2013\/05\/toxic-tick-tock.png\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-7415 aligncenter\" src=\"http:\/\/whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2013\/05\/toxic-tick-tock.png\" alt=\"toxic tick tock\" width=\"169\" height=\"288\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hazardous substance consents at Rhodia&#8217;s Trinity Street factory Oldbury &nbsp; BACKGROUND \u201cEffluent arisings from across the site were treated to produce a slurry.
